Patent Licensing
Agreement
IEEE 1284.4
To be granted the IEEE 1284.4 license, please read the
following agreement and fill out the form.
This is a legal agreement between you (the Licensee)
and the licensing companies, Hewlett-Packard Company ("HP")
and QualityLogic Incorporated ("QualityLogic"). HP and QualityLogic
jointly hold the patent #5,453,982.
License. Under these terms, HP and QualityLogic will
grant to you, the Licensee, a nonexclusive, nontransferable license to
use the patent referenced above, plus any others that they hold either
individually or in common strictly necessary to implement the Institute
of Electrical and Electronics Engineers ("IEEE") protocol designated
"1284.4" or the "protocol".
Exceptions. Licensee may create certain derivative works
in connection to the protocol. HP and QualityLogic in this agreement license
only the patents needed to implement a strict interpretation of 1284.4.
Extensions and adaptations of the protocol may use the same set of patents
licensed for the basic protocol pursuant to the "Extensions"
clause below. No additional patents are licensed in this agreement for
functionality or behavior beyond that described in the IEEE 1284.4 specification.
Warranties and Limitation of Remedies. Licensee assumes
all risk associated with licensee's use of the patents supplied by HP
or QualityLogic. Neither HP nor QualityLogic agree to defend or settle
any claims against Licensee or its customers for any implementation that
infringes on any patent or copyright not legally held by either HP or
QualityLogic. As with virtually all standards, the Licensee is responsible
for insuring that its implementation and documentation do not infringe
on any patents, copyrights, or other forms of intellectual property not
specifically addressed as part of this agreement.
Trademarks. None of the parties is granted any right
or interest to the trademarks, marks or trade names of other parties.
Neither the licensee nor the licensing companies may use the other's trademarks,
marks or trade names without the prior written consent of the other party.
Extensions. Licensee may create a derivative work in
the following manner, and still retain the right to license the patents
held by HP and QualityLogic as specified:
- Adaptation of the protocol to a new type of hardware
connection. The protocol is defined as a parallel port ("1284")
specific communications standard, but may be adapted freely to serial
connections (such as IEEE 1394 or Universal Serial Bus) or network technologies
(such as Ethernet, etc.).
- Additional functionality. Licensee is free to add
"enhanced" functionality as long as a best efforts attempt
is made to remain compliant with the original standard. Specifically,
the Licensee is allowed and encouraged to implement the protocol in
such as way that it is compliant with both IEEE 1284.4 and HP's Multiple
Logical Channels (MLC) protocol, for connection to legacy HP devices.
Extension Exceptions. Licensee is not permitted to implement
a protocol pursuant to this agreement whose purpose is not related to
supporting the IEEE 1284.4 protocol. For instance:
- An implementation of Hp's MLC protocol is not allowed unless the implementation
also supports the IEEE 1284.4 standard.
- Use of the patents to extend an unrelated protocol stack, such as
TCP/IP, IPX, or IrDA protocols, is not allowed.
Payment. HP and QualityLogic grant this license free
of charge under the above terms and conditions.
